1. Acceptance of Terms
Welcome to Caribbean Real Estate Hub (“CRH,” “we,” “us,” or “our”). By accessing or using the CRH website and services (the “Site” or “Platform”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). These Terms constitute a legal agreement between you (“User” or “you,” whether as a buyer, seller, agent, developer, bank, or other participant) and Caribbean Real Estate Hub. If you do not agree with any part of these Terms, you must not use the Site.
2. Description of Services
Caribbean Real Estate Hub is a centralized real estate listing and lead generation platform for the Caribbean region. Our Platform enables users to list properties for sale or rent, advertise real estate services, and connect with potential buyers, sellers, real estate agents, construction companies, and financial institutions. We do not act as a real estate broker or agent for any party; CRH is an online venue to facilitate connections and information exchange. Any real estate transactions or agreements resulting from use of our Platform are solely between the involved parties, and wearty to any sale, purchase, rental, financing, construction contract, or other real estate transaction**.
3. Eligibility and Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Site. By using the Platform, you represent that you are legally capable of entering into binding contracts. Some features may require you to create an account. When creating an account, you agree to provide truthful, current, and complete information. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate any account that we suspect is being used in violation of these Terms or any applicable law.
4. User Roles and Responsibilities
4.1. Property Listings: If you post property listings or other content on CRH, you are considered a Listing Provider. Listing Providers (such as property owners, agents, or developers) are responsible for ensuring that all information in their listings (including property descriptions, prices, location, photos, etc.) is accurate and up-to-date, and that they have the legal right to post such content. All property listings and information are provided by the users or third parties; CRH does not guarantee their accuracy or completeness. Information in listings is subject to change, and prospective buyers or renters should perform their own due diligence and independent verification of any property details before proceeding with a transaction. By posting a listing, you grant CRH a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your listing content on our Platform and in related marketing or promotional materials. This license is solely for the purpose of operating and promoting the Platform. You retain ownership of your content, and this license does not restrict your right to use the same content elsewhere.
4.2. Inquiries and Leads: If you express interest in a property or service on the Platform (for example, by contacting a listing or filling out a form for more information), you are considered an Interested Party. Interested Parties consent to have their contact information and inquiry details shared with the relevant Listing Provider or partner in order to facilitate a connection. For instance, if you inquire about a property, your name and contact details will be sent to the property’s seller or agent so they can respond to you. Similarly, if you request information about financing or mortgage options, you agree that we may forward your inquiry and contact information to participating banks or financial institutions who may contact you regarding loan products. CRH simply facilitates these connections and does not guarantee that any Listing Provider or partner will contact you or that any transaction will occur.
4.3. Real Estate Professionals and Partners: Real estate agents, brokers, construction companies, banks, or other service providers (collectively, “Partners”) may use our Platform to showcase their services or respond to leads. If you are using the Site as a Partner (e.g., claiming an agent profile, posting services, or receiving leads), you additionally agree to abide by any applicable professional licensing requirements and industry regulations. You are solely responsible for your interactions with other users and any services or advice you provide outside the Platform. CRH does not endorse or guarantee any Partner or their services. However, by using the Platform, you agree to conduct yourself and your business with integrity and in compliance with all applicable laws and ethical standards.
5. Permitted Use and Prohibited Activities
You agree to use Caribbean Real Estate Hub only for its intended purposes and in a lawful manner. Prohibited activities include, without limitation:
- Misrepresentation or Fraud: Posting any false, misleading, or fraudulent information on the Site. You must not impersonate any person or entity or falsify your affiliation with any person or entity.
- Intellectual Property Infringement: Uploading or sharing content (including text or images) that you do not have the right to use, or that infringes upon the copyright, trademark, or other intellectual property rights of any third party. You must own or have permission for all content you post.
- Unlawful Content: Transmitting any content that is unlawful, harassing, libelous, abusive, obscene, defamatory, pornographic, or that violates any law or the rights of others. You must not use the Platform to engage in discrimination or violate fair housing laws (e.g., no discriminatory preferences in listings).
- Interference and Hacking: Attempting to interfere with the proper functioning of the Site or any user’s use of the Site. This includes not introducing viruses, malware, or any other harmful code; not attempting to gain unauthorized access to any portion of the Site, other user accounts, or CRH’s systems; and not using any robot, scraper, crawler, or other automated means to access or extract data from the Site (except as permitted via public search engine indexing).
- Data Mining and Harvesting: You agree not to scrape, extract, or harvest data from the Site for any commercial purpose without our prior written permission. Collecting users’ personal information (including contact details) without their consent is strictly prohibited.
- Spam and Unsolicited Contact: You will not use the communication tools provided by the Platform to send unsolicited or bulk communications, spam, chain letters, or any similar conduct. When contacting someone via information obtained from our Site (such as an agent or seller), you will do so only regarding legitimate real estate interest and not for unrelated marketing.
- Circumvention of Security: You will not bypass or attempt to bypass any measures we use to prevent or restrict access to the Site (such as attempting to override any account registration or verification processes, or accessing portions of the Site you are not authorized to access).
We reserve the right (but have no obligation) to monitor user activity on the Platform and to remove or edit any content or listings that we determine, in our sole discretion, violate these Terms or applicable law. Any unauthorized use of the Platform may result in termination of your rights to use the Site and may be referred to law enforcement.
6. Content and Intellectual Property
6.1. User-Provided Content: You acknowledge that most content on CRH is provided by independent users or third parties – for example, property descriptions by sellers or agents, or service descriptions by partners. We do not control or vet user-provided content in advance, and thus we are not responsible for the accuracy, reliability, or legality of any content posted by users. Your interactions with other users (including any transactions or communications) are solely between you and the other party; CRH is not liable for any issues or disputes arising from such interactions. However, if you notice content that you believe violates these Terms or is unlawful (for example, fraudulent listings, copyright infringement, or false information), please report it to us using the contact information in Section 13, and we will investigate and take appropriate action at our discretion.
By posting any content on our Platform, you represent and warrant that: (a) you have all necessary rights and permissions to post that content; (b) the content is accurate to the best of your knowledge and not misleading; and (c) the content and its use on our Site will not violate any third-party rights or laws. You grant CRH and its affiliates the right to use, copy, display, distribute, and adapt your content as needed to operate and promote the Site. This license to us ends when you remove your content from the Platform, except that we may retain backup copies for a limited time and may retain archival copies for record-keeping as required by law.
6.2. CRH Intellectual Property: All content and materials available on the Site (except for user-provided content), including but not limited to the CRH logo and branding, text, graphics, website layout and design, software code, and databases, are owned by Caribbean Real Estate Hub or our licensors and are protected by copyright, trademark, and other intellectual property laws. Caribbean Real Estate Hub™ and associated logos or slogans are trademarks/service marks of our company. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site and CRH content for your personal, non-commercial use in connection with your legitimate use of our services. You may not reproduce, distribute, create derivative works from, publicly display, or commercially exploit any portion of the Site or our content without our express written consent, except as allowed under applicable law. Any scraping, data mining, framing, or similar use of the Site or its content in violation of these Terms is strictly prohibited.
If you are a search engine or other provider of public archives, we may grant limited exceptions from these restrictions for the purpose of transparency and public record (for example, search engines indexing the site), at our discretion – but such exceptions do not permit any use that would violate the privacy of our users or the integrity of our services.
6.3. No Endorsement: Use of any third-party logos or trademarks on the Site (such as those of partner banks, agencies, or developers) is solely to refer to those parties’ services, and does not imply any endorsement by or partnership with CRH unless expressly stated. Likewise, third parties’ use of the CRH name or logo must be authorized in writing.
7. Third-Party Services and Links
Our Platform may integrate or provide links to third-party resources, content, or services that are not owned or controlled by Caribbean Real Estate Hub. This may include, for example, links to external websites for property details, advertisements or promotions from partner companies, Google Maps for location visualization, or embedded tools provided by third parties.
7.1. Third-Party Listings and Services: Some property listings or real estate services featured on CRH may be provided through feeds or arrangements with third-party listing services, brokers, or Multiple Listing Services (MLS). We cannot guarantee and do not warrant the quality, accuracy, or completeness of information, products, or services provided by third parties on our Site. Any statements, opinions, or offers made by third parties (including advertisers, listing providers, or Partners) are those of the respective third party and not of CRH. If you choose to engage with a third-party service (for example, clicking on a mortgage offer from a bank, or hiring a construction firm you found on our Platform), you will be subject to that third party’s terms and policies. CRH is not responsible for any dealings you have with third parties, and any transactions or obligations arising from such dealings are solely between you and the third party.
7.2. External Links: The Site may contain links to external websites or resources that are provided for your convenience and reference only (for example, a link to a developer’s website, a news article, or a government land registry). We have no control over the content, privacy practices, or reliability of those external sites, and accept no responsibility for them. Visiting any third-party websites linked from our Platform is at your own risk. We encourage you to read the terms and privacy policies of any third-party site you visit via links from CRH.
7.3. Advertisements and Promotions: CRH may display advertisements, sponsored listings, or promotional content (“Ads”) on the Platform. These Ads may be tailored to users (for instance, based on property location or user interest) and may be provided by CRH or third-party advertising partners. We do not endorse any third-party products or services advertised, and it is your responsibility to evaluate the accuracy and legitimacy of any advertisements. Any information you provide to advertisers (for example, by clicking an ad and entering information on a third-party site) is provided directly to that third party, and CRH is not responsible for how it is used. Advertisers are solely responsible for the content of their ads and for ensuring that they are not false or misleading. However, if you encounter an ad on our Site that you believe is inappropriate or scam-related, please inform us.
7.4. Google Maps and Third-Party APIs: Our Site integrates Google Maps and related Google sGoogle API Services”) to provide location-based features such as interactive maps and address auto-completion. By using the Site, you agree to be bound by Google’s Terms of Service for these features. Specifically, usage of Google Maps on CRH is subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy. We incorporate Google’s terms here by reference. This means, for example, that Google may collect certain information (such as your IP address or location coordinates) when you use map features on our Site, and such use is governed by Google’s own terms and privacy policy, not just ours. We will notify users in our Privacy Policy that we use Google API services and that Google’s Privacy Policy applies. If you do not agree to Google’s terms or to us using these services in providing features, please refrain from using the map functionalities on our Platform.
8. Payments, Fees, and Subscriptions
8.1. Free Services: At launch, Caribbean Real Estate Hub offers basic services (such as browsing listings, creating a standard listing, and contacting other users) free of charge. You may use the Platform and its core features without payment. However, you are responsible for any costs associated with your use of the internet or data to access our Site.
8.2. Introduction of Paid Services (Effective October 2025): We plan to introduce optional paid services starting in October 2025. These may include, for example, Premium Listings (paid property advertisements with enhanced visibility), Subscription Packages for real estate professionals (providing additional features or lead access), and Advertising Opportunities for third parties. When such paid services become available, additional terms and conditions (including pricing, payment terms, and any subscription renewal terms) will be provided and will apply to those who choose to purchase them. By opting into any paid service, you agree to pay all applicable fees and charges as described at the time of purchase.
8.3. Payment Process: Paid services will likely require payment via credit card, electronic payment processors, or other methods we specify. All payment information will be processed securely via our third-party payment processor. You authorize us (or our payment provider) to charge your selected payment method for the fees and any applicable taxes. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms, and we reserve the right to suspend or terminate your access to paid features until payment is received in full.
8.4. Subscriptions and Renewals: If a service is offered on a subscription basis (e.g., monthly or annual plans for agents), the subscription will automatically renew at the end of each billing period unless you cancel in advance. We will notify you of the renewal and any change in price in accordance with applicable laws. You can cancel subscription services at any time via your account settings or by contacting us, in which case your subscription will not renew after the current paid term. No pro-rated refunds will be provided for the remainder of any billing period unless required by law or explicitly stated in the specific service terms.
8.5. No Refunds Policy: Fees for paid services (such as premium listing fees or subscription charges) are generally non-refundable, except where we are required to provide a refund under consumer protection laws or as expressly stated otherwise. If you believe there are extenuating circumstances (for example, you paid for a service that was not delivered), you may contact us to request a review, and we will consider refund requests on a case-by-case basis at our sole discretion.
8.6. Changes to Fees: We reserve the right to change our fees or introduce new pricing for any services, at our discretion, with reasonable notice to you. Fee changes will not affect services already purchased until it’s time for renewal. If you do not agree with a fee change, you may cancel the service before the new fees take effect. Continued use of the paid service after the fee change goes into effect constitutes your agreement to pay the updated amount.
9. Disclaimers
9.1. “As Is” Basis: Caribbean Real Estate Hub provides the Site and all services and content on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties and representations of any kind, whether express, implied, or statutory, including but not limited to any warranties of accuracy, reliability, non-infringement, merchantability, or fitness for a particular purpose. Use of the Platform and reliance on any information obtained through the Platform is at your own risk. We do not guarantee that the Site will be uninterrupted, error-free, or secure. We also do not guarantee any results from using the Platform (for example, we make no promise that using our Site will result in a successful real estate sale, purchase, or any specific outcome).
9.2. No Professional Advice: Any information available on CRH, including articles, guides, FAQs, or data on property values, is provided for general informational purposes only. It is not intended as professional advice (financial, legal, real estate, or otherwise). Users should consult appropriate professionals (such as licensed real estate brokers, lawyers, or financial advisors) for advice tailored to their situation. CRH does not guarantee the accuracy or applicability of any general information to your circumstances.
9.3. No Guarantee of Security: While we strive to maintain reasonable security measures, we make no warranty that the Site is free of viruses or other harmful components. You are responsible for implementing safeguards (like antivirus software) to protect your devices and data.
9.4. Third-Party Content: We specifically disclaim any responsibility or liability for content provided by third parties (including listings, reviews, advertisements, or linked websites). We make no guarantee regarding the authenticity, quality, safety, or legality of any properties, products, or services advertised or listed by users on our Platform. CRH is not responsible for the actions or omissions of any third parties that users connect with through our Site.
9.5. Location Data: Any maps or location data provided (e.g., via Google Maps integration) are for convenience. Exact locations may be approximate, and mapping data is subject to the terms and accuracy of Google or other providers. We do not warrant the accuracy of any map or direction provided on the Platform.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Caribbean Real Estate Hub, its owners, directors, officers, employees, affiliates, or agents be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, business opportunities, goodwill, data, or other intangible losses. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damages.
CRH and its affiliates will not be liable for any actions, claims, losses, damages, liabilities, or expenses (including legal fees) arising out of or relating to your use of the Site, the content on the Site, or any transaction or relationship between you and any third party (including other users) initiated through the Platform.
In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability will be limited to the fullest extent permitted by law. In no case shall our total cumulative liability to you for any claims arising out of or relating to these Terms or the use of the Site exceed the greater of: (a) the total amount (if any) you paid to us for any paid services in the 6 months immediately before the claim, or (b) USD $100.
This section does not limit or exclude liability for gross negligence, willful misconduct, or fraud, or any other liability that cannot be excluded under applicable law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Caribbean Real Estate Hub and our directors, officers, employees, agents, partners, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Site or any services; (b) your violation of these Terms or any applicable law or regulation; (c) your infringement of any intellectual property or other rights of any person or entity; or (d) any dispute or issue between you and any third party (such as a transaction or interaction with another user or advertiser). This indemnification obligation will continue even after you stop using our Site or services.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in such case, you agree to cooperate with our defense of that claim.
12. Termination
12.1. By Users: You may stop using our Platform at any time. If you have an account, you can deactivate or delete it by contacting us. Termination of your account will not automatically remove content you have posted (e.g., property listings) from the Site; you should remove any content you do not wish to remain available prior to terminating your account. However, we will remove or anonymize your personal information associated with the content upon request, in accordance with our Privacy Policy and applicable law.
12.2. By CRH: We may, in our sole discretion, suspend or terminate your access to the Site (or certain features) at any time, with or without notice, for any valid reason, including but not limited to: your actual or suspected breach of these Terms, your engagement in fraudulent or illegal activities, extended periods of inactivity of your account, our need to discontinue the service, or unexpected technical or security issues. We will not be liable to you or any third party for any such termination of your access. If we terminate your paid services without cause, we may provide a pro-rata refund for any remaining prepaid period; however, no refund will be given for terminations due to your misconduct or breach of Terms.
12.3. Effect of Termination: Upon termination of your account or access, your right to use the Platform will immediately cease. Sections of these Terms that by their nature should survive termination (such as intellectual property rights, disclaimers, limitation of liability, indemnity, governing law, etc.) shall survive and continue to be enforceable.
13. Changes to These Terms
We may revise or update these Terms and Conditions from time to time. If we make material changes, we will provide notice to users by posting the updated Terms on our Site and updating the “Last Updated” date at the top, and/or by sending an email notification to registered users (if applicable). It is your responsibility to review these Terms periodically. By continuing to use the Platform after any changes come into effect, you agree to be bound by the revised Terms. If you do not agree to the updated Terms, you must stop using the Site.
14. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of Barbados, without regard to its conflict of law principles. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site that cannot be resolved informally shall be brought exclusively in the courts of Barbados. You consent to the personal jurisdiction of these courts. Notwithstanding the foregoing, Caribbean Real Estate Hub may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of our intellectual property or other rights.
If you are using the Site in a jurisdiction that does not allow the above choice of law or forum, this Governing Law section shall apply to the maximum extent permitted. Regardless of any statute or law to the contrary, you agree that any claim or cause of action by you arising out of or related to use of the Site or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred.
15. Miscellaneous
15.1. No Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or of the right to enforce it in the future.
15.2. Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect. We may, in good faith, replace any invalid provision with one that is enforceable and that comes closest to the original intent and economic effect of the invalid provision.
15.3. Entire Agreement: These Terms (along with any additional guidelines, policies, or rules expressly incorporated herein, such as our Privacy Policy) constitute the entire agreement between you and Caribbean Real Estate Hub regarding your use of the Platform, and supersede any prior agreements or understandings (whether oral or written) relating to the subject matter. In case of any conflict between these Terms and any other policy on the Site, these Terms shall control.
15.4. Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations to an affiliate or in connection with a merger, acquisition, sale of assets, or by operation of law.
15.5. No Third-Party Beneficiaries: These Terms are for the benefit of you and CRH (and our successors and permitted assigns) only. No third party shall have any rights to enforce any terms herein, except as expressly provided (for example, our affiliates and indemnitees as stated in Section 11 have the right to enforcement).
15.6. Relationship of Parties: Nothing in these Terms shall be construed as making either party the partner, joint venturer, agent, legal representative, employer, contractor, or employee of the other. We are an independent service provider, and you are using the Platform as a user or independent professional.
